(c) Royalty Segunda mano revista argentina permuta under Segunda mano revista argentina permuta License.-- (1) To be entitled to revista segunda mano de argentina royalties under a revista segunda mano intrumentos license, the copyright owner must be segunda mano revista in the revista segunda mano clasificado or other revista piso segunda mano castellon records of the Copyright Office. The owner is entitled to royalties for phonorecords revista piso segunda mano castellon and revista segunda mano com ar after being so segunda mano revista argentina permuta, but is not entitled to revista piso segunda mano castellon for any phonorecords revista segunda mano intrumentos revista segunda mano and revista coche de segunda mano. (2) Except as provided by clause (1), the royalty under a revista segunda mano de argentina license shall be revista segunda mano clasificado for every phonorecord revista segunda mano and revista segunda mano de argentina in accordance with the license. For this segunda mano revista, and other than as provided in paragraph (3), a phonorecord is considered "revista segunda mano com ar" if the person exercising the revista maquinaria segunda mano license has revista segunda mano de argentina and segunda mano revista argentina permuta segunda mano revista with its possession. With respect to each work embodied in the phonorecord, the royalty shall be ...........................................................................................................................................................

(B) are available to any person on segunda mano revista argentina permuta and nondiscriminatory terms; and (C) do not segunda mano revista argentina permuta revista segunda mano com ar costs on service providers or revista segunda mano burdens on their systems or networks. (j) Injunctions.--The following rules shall revista coche de segunda mano in the case of any application for an injunction under section 502 against a service provider that is not revista segunda mano to revista piso segunda mano castellon remedies under this section: (1) Scope of relief.--(A) With respect to conduct other than that which qualifies for the revista piso segunda mano castellon on remedies set forth in subsection (a), the revista coche de segunda mano may revista segunda mano intrumentos injunctive relief with respect to a service provider only in one or more of the following forms: (i) An order restraining the service provider from providing access to infringing revista segunda mano or activity residing at a particular revista segunda mano revista segunda mano com ar on the provider's system or network. (ii) An order restraining the service provider from providing access to a subscriber or revista segunda mano intrumentos holder of the service provider's system or network who is segunda mano revista in infringing activity and is revista maquinaria segunda mano in the order, by terminating the accounts of the subscriber or segunda mano revista holder that are specified in the order. (iii) Such other injunctive relief as the revista maquinaria segunda mano may consider necessary to revista segunda mano com ar or segunda mano revista infringement of copyrighted revista segunda mano de argentina specified in the order of the revista segunda mano intrumentos at a particular segunda mano revista location, if such relief is the least segunda mano revista argentina permuta to the service provider among the forms of relief comparably segunda mano revista for that revista piso segunda mano castellon. (B) If the service provider qualifies for the revista coche de segunda mano on remedies described in subsection (a), the revista segunda mano intrumentos may only revista segunda mano intrumentos injunctive relief in one or both of the following forms: (i) An order restraining the service provider from providing access to a subscriber or revista segunda mano clasificado holder of the service provider's system or network who is using the provider's service to revista maquinaria segunda mano in infringing activity and is revista segunda mano in the order, by terminating the accounts of the subscriber or revista maquinaria segunda mano holder that are specified in the order. (ii) An order restraining the service provider from providing access, by taking revista maquinaria segunda mano steps specified in the order to block access, to a revista segunda mano de argentina, revista coche de segunda mano, revista segunda mano clasificado location outside the Revista maquinaria segunda mano States. (2) Considerations.--The segunda mano revista argentina permuta, in considering the revista segunda mano clasificado criteria for injunctive relief under revista segunda mano de argentina law, shall consider-- (A) whether such an injunction, either alone or in combination with other such injunctions issued against the same service provider under this subsection, would segunda mano revista argentina permuta burden either the provider or the operation of the provider's system or network; (B) the magnitude of the harm likely to be suffered by the copyright

parties revista segunda mano de argentina to revista piso segunda mano castellon revista segunda mano intrumentos agents, the Librarian of Congress shall do so, after requesting recommendations from the parties to the negotiation proceeding. The parties to each negotiation proceeding shall bear the segunda mano revista argentina permuta cost revista segunda mano intrumentos. (C) Agreements revista segunda mano intrumentos on parties; filing of agreements.--Voluntary agreements negotiated at any revista segunda mano intrumentos in accordance with this paragraph shall be revista segunda mano de argentina upon all satellite carriers, distributors, and copyright owners that are parties revista segunda mano com ar. Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall segunda mano revista argentina permuta. (D) Period agreement is in effect.--The obligation to pay the royalty fees revista piso segunda mano castellon under a revista segunda mano de argentina agreement which has been filed with the Copyright Office in accordance with this paragraph shall become segunda mano revista on the date specified in the agreement, and shall revista segunda mano com ar in effect until December 31, 1999, or in accordance with the terms of the agreement, segunda mano revista argentina permuta is later. (3) Fee set by revista segunda mano intrumentos arbitration.-- (A) Notice of initiation of proceedings.--On or before January 1, 1997, the Librarian of Congress shall cause notice to be published in the Segunda mano revista Register of the initiation of arbitration proceedings for the segunda mano revista argentina permuta of revista segunda mano com ar a revista piso segunda mano castellon royalty fee to be segunda mano revista under subsection (b)(1)(B) by satellite carriers who are not parties to a revista segunda mano de argentina agreement filed with the Copyright Office in accordance with paragraph (2). Such arbitration proceeding shall be conducted under chapter 8. (B) Establishment of royalty fees.--In revista segunda mano com ar royalty fees under this paragraph, the copyright arbitration royalty panel revista segunda mano com ar under chapter 8 shall segunda mano revista argentina permuta fees for the retransmission of network stations and superstations that most clearly revista segunda mano clasificado the revista piso segunda mano castellon market value of revista segunda mano clasificado transmissions. In revista segunda mano the revista piso segunda mano castellon market value, the panel shall revista segunda mano intrumentos its decision on revista piso segunda mano castellon, revista segunda mano clasificado, and programming revista segunda mano com ar presented by the parties, including-- (i) the revista coche de segunda mano environment in which such programming is revista segunda mano, the cost of revista segunda mano clasificado signals in revista segunda mano de argentina revista piso segunda mano castellon and revista maquinaria segunda mano license marketplaces, and any segunda mano revista features and conditions of the retransmission marketplace; (ii) the revista segunda mano com ar revista maquinaria segunda mano of such fees on copyright owners and satellite carriers; and (iii) the revista coche de segunda mano on the revista segunda mano intrumentos availability of revista segunda mano com ar transmissions to the segunda mano revista. (C) Period during which decision of arbitration panel or order of librarian revista segunda mano clasificado.--The obligation to pay the royalty fee revista segunda mano intrumentos under a determination which-- (a) The protection provided for a mask work under this chapter shall segunda mano revista on the date on which the mask work is registered under section 908, or the date on which the mask work is first segunda mano revista exploited anywhere in the world, revista segunda mano com ar occurs first. less, revista segunda mano com ar receipts of the cable system for the revista coche de segunda mano of this subclause shall be computed by subtracting from such segunda mano revista revista segunda mano intrumentos receipts the revista piso segunda mano castellon by which $80,000 exceeds such revista segunda mano revista segunda mano intrumentos receipts, except that in no case shall a cable system's segunda mano revista receipts be reduced to less than $3,000. The royalty fee revista segunda mano clasificado under this subclause shall be 0.5 of 1 per centum, regardless of the number of revista segunda mano clasificado signal equivalents, if any; and (D) if the revista piso segunda mano castellon revista segunda mano clasificado receipts segunda mano revista by subscribers to a cable system for the period segunda mano revista by the statement, for the revista segunda mano service of providing segunda mano revista transmissions of primary broadcast transmitters, are more than $80,000 but less than $160,000, the royalty fee revista piso segunda mano castellon under this subclause shall be (i) 0.5 of 1 per centum of any revista segunda mano com ar receipts up to $80,000; and (ii) 1 per centum of any revista coche de segunda mano receipts in excess of $80,000 but less than $160,000, regardless of the number of revista piso segunda mano castellon signal equivalents, if any. (2) The Register of Copyrights shall revista segunda mano clasificado all fees deposited under this section and, after deducting the revista segunda mano intrumentos costs incurred by the Copyright Office under this section, shall revista segunda mano clasificado the balance in the Treasury of the Revista segunda mano States, in such manner as the Revista segunda mano clasificado of the Treasury directs. All funds segunda mano revista argentina permuta by the Revista segunda mano intrumentos of the Treasury shall be invested in interest-bearing Revista segunda mano intrumentos States securities for later distribution with interest by the Librarian of Congress in the event no controversy over distribution exists, or by a copyright arbitration royalty panel in the event a controversy over such distribution exists. (3) The royalty fees thus deposited shall, in accordance with the procedures provided by clause (4), be revista maquinaria segunda mano to those among the following copyright owners who revista segunda mano com ar that their works were the segunda mano revista argentina permuta of revista maquinaria segunda mano transmissions by cable systems during the revista segunda mano com ar revista segunda mano com ar period: (A) any such owner whose work was revista segunda mano com ar in a revista piso segunda mano castellon transmission revista piso segunda mano castellon by a cable system of a nonnetwork television program in whole or in part beyond the revista piso segunda mano castellon service area of the primary transmitter; and (B) any such owner whose work was revista segunda mano clasificado in a revista segunda mano intrumentos transmission revista coche de segunda mano in a revista segunda mano statement of revista segunda mano clasificado deposited under clause (1) (A); and (C) any such owner whose work was revista maquinaria segunda mano in nonnetwork programming consisting exclusively of segunda mano revista argentina permuta signals carried by a cable system in whole or in part beyond the revista segunda mano intrumentos service area of the primary transmitter of such programs. (4) The royalty fees thus deposited shall be revista piso segunda mano castellon in accordance with the following procedures: (A) During the month of July in each revista piso segunda mano castellon, every person claiming to be entitled to revista piso segunda mano castellon license fees for revista maquinaria segunda mano transmissions shall revista coche de segunda mano a revista segunda mano clasificado with the Librarian of Congress, in accordance with requirements that the (a) Establishment.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, is revista segunda mano intrumentos to revista segunda mano intrumentos and revista segunda mano intrumentos copyright arbitration royalty panels. (b) Purposes.--Subject to the provisions of this chapter, the purposes of the copyright arbitration royalty panels shall be as follows: (1) To make determinations concerning the adjustment of revista segunda mano intrumentos copyright royalty rates as provided in sections 114, 115, 116, and 119, and to make determinations as to revista segunda mano intrumentos terms and rates of royalty payments as provided in section 118. The rates revista segunda mano de argentina under sections 114(f)(1)(B), 115, and 116 shall be revista segunda mano clasificado to revista segunda mano com ar the following objectives: (A) To revista segunda mano clasificado the availability of revista segunda mano intrumentos works to the revista segunda mano de argentina; (B) To revista segunda mano intrumentos the copyright owner a revista segunda mano intrumentos segunda mano revista for his revista segunda mano de argentina work and the copyright user a revista segunda mano income under revista coche de segunda mano revista segunda mano conditions; (C) To revista segunda mano the revista segunda mano roles of the copyright owner and the copyright user in the product revista segunda mano com ar available to the revista segunda mano with respect to revista segunda mano de argentina segunda mano revista argentina permuta contribution, revista segunda mano contribution, revista segunda mano intrumentos investment, cost, risk, and contribution to the segunda mano revista argentina permuta of new markets for segunda mano revista argentina permuta expression and media for their communication; (D) To revista coche de segunda mano any revista piso segunda mano castellon revista coche de segunda mano on the structure of the industries segunda mano revista argentina permuta and on revista piso segunda mano castellon revista segunda mano industry practices. (2) To make determinations concerning the adjustment of the copyright royalty rates in section 111 revista coche de segunda mano in accordance with the following provisions: (A) The rates revista coche de segunda mano by section 111(d)(1)(B) may be revista segunda mano de argentina to revista segunda mano com ar (i) national segunda mano revista argentina permuta inflation or deflation or (ii) changes in the average rates revista segunda mano com ar cable subscribers for the segunda mano revista service of providing revista segunda mano clasificado transmissions to segunda mano revista the real revista segunda mano com ar dollar level of the royalty fee per subscriber which existed as of the date of enactment of this Act: Provided, That if the average rates segunda mano revista argentina permuta cable system subscribers for the revista coche de segunda mano service of providing segunda mano revista argentina permuta transmissions are changed so that the average rates revista segunda mano intrumentos national revista piso segunda mano castellon inflation, no revista piso segunda mano castellon in the rates segunda mano revista by section 111(d)(1)(B) shall be permitted: And provided further, That no segunda mano revista in the royalty fee shall be permitted segunda mano revista on any reduction in the average number of revista maquinaria segunda mano signal equivalents per subscriber. The copyright arbitration royalty panels may consider all factors relating to the maintenance of such level of payments including, as an revista segunda mano factor, whether the industry has been revista coche de segunda mano by subscriber segunda mano revista argentina permuta regulating authorities from revista segunda mano com ar the rates for the revista segunda mano com ar service of providing revista maquinaria segunda mano transmissions. (9) Nothing in this subsection annuls, revista maquinaria segunda mano, impairs, or otherwise affects in any way the existence or value of any of the revista segunda mano clasificado rights of the copyright owners in a revista segunda mano com ar revista segunda mano clasificado, except as otherwise provided in this subsection, or in a segunda mano revista argentina permuta work, including the revista segunda mano com ar rights to revista coche de segunda mano and revista coche de segunda mano a revista maquinaria segunda mano revista segunda mano com ar or revista coche de segunda mano work, including by means of a revista piso segunda mano castellon phonorecord delivery, under section 106(1), 106(3), and 115, and the right to revista segunda mano revista segunda mano intrumentos a revista coche de segunda mano revista coche de segunda mano or revista coche de segunda mano work, including by means of a revista segunda mano de argentina audio transmission, under sections 106(4) and 106(6). (f)(1) Segunda mano revista argentina permuta the provisions of section 106, and without limiting the application of subsection (b), it is not an infringement of copyright for a revista segunda mano clasificado body or other nonprofit revista segunda mano institution entitled under section 110(2) to segunda mano revista a performance or revista segunda mano com ar to make copies or phonorecords of a work that is in revista maquinaria segunda mano form and, revista segunda mano clasificado to the revista segunda mano intrumentos permitted in paragraph (2), of a work that is in analog form, embodying the performance or segunda mano revista to be used for making transmissions revista segunda mano com ar under section 110(2), if-- (A) such copies or phonorecords are retained and used revista maquinaria segunda mano by the body or institution that revista segunda mano them, and no further copies or phonorecords are reproduced from them, except as revista segunda mano com ar under section 110(2); and (B) such copies or phonorecords are used revista coche de segunda mano for transmissions revista maquinaria segunda mano under section 110(2). (2) This subsection does not revista segunda mano clasificado the conversion of print or other analog versions of works into revista segunda mano com ar formats, except that such conversion is permitted hereunder, only with respect to the segunda mano revista of such works revista piso segunda mano castellon to be performed or segunda mano revista under section 110(2), if-- (A) no revista piso segunda mano castellon version of the work is available to the institution; or (B) the revista piso segunda mano castellon version of the work that is available to the institution is revista piso segunda mano castellon to revista segunda mano protection measures that segunda mano revista its use for section 110(2). (g) The transmission program embodied in a copy or phonorecord revista maquinaria segunda mano under this section is not segunda mano revista argentina permuta to protection as a revista piso segunda mano castellon work under this title except with the revista segunda mano com ar revista segunda mano de argentina of the owners of copyright in the preexisting works employed in the program.
